Eligibility
Contest entrants must be at least 21 years old as of January 1, 2008. This contest is sponsored by Bluetooth SIG. Employees, owners, or management of Bluetooth SIG, and their respective household members are not eligible. All federal, state, and local laws and regulations apply. Void wherever prohibited or restricted by law. Registrants can only win ONE prize package and become a finalist during the promotion. Registrants who have already won a prize and/or become a finalist are NOT eligible to register again during this contest. Only ONE member of each household can become a finalist in the contest.
All Entries must be received before 12:01 GMT on December 12, 2008. Bluetooth SIG is not responsible for entries lost or delayed or not received for any other reason, or for errors in the entry forms or the rules or any computer hardware/software malfunction. Bluetooth SIG reserves the right to announce the winners.
Selection of Winners
Winners will be selected by Bluetooth SIG staff from among all eligible entries received during the Entry Period. Bluetooth SIG will notify the winner via email. Winners will be required to sign an Affidavit of Eligibility/Liability Release and where legal, a Publicity Release, within 14 days of notification attempt. Failure to return the affidavit in the time noted will result in disqualification and an alternate entrant will be selected. Any prize not accepted may be forfeited for future use by Bluetooth SIG or returned to the prize donor. Winners must consent to publication of their winning story/photos in a future issue of the Bluetooth SIG's quarterly magazine, SIGnature.
Odds of Winning
Odds of winning depend upon the number of eligible entries received. Entry constitutes permission (except where prohibited by law) to use winners' name, hometown and likeness for publicity purposes without additional compensation.
Limit of Entry
All members of a household that meet the eligibility requirements can enter the contest and to become a finalist. Only ONE member of each household can become a finalist in the contest. By entering, entrants acknowledge compliance with these official rules including all eligibility requirements. Bluetooth SIG is not responsible for delayed, lost or misdirected entries, delays in mail or other services, or failures in technology such as but not limited to: technical malfunctions, lost/delayed data transmission, line failures of any telephone network, computer equipment, software, inability to access any Web site or online service, inaccurate transcription of entry information, or for any human error, or misdirected entries. Entry materials that have been tampered with or altered are void. No copies, facsimiles or reproductions of registration materials or entry form will be accepted.
Prizes
Prizes are various Bluetooth enabled products donated by various sponsors and merchants of Bluetooth enabled merchandise. Prize value may be up to $1,100.00 (U.S.). Prize is non-transferable, cannot be substituted, combined with any other offer or redeemed for cash. All taxes on the prize, including but not limited to income and sales taxes, are the responsibility of the winner.
Other Important Points
Contest participants, by entering, release Bluetooth SIG and their respective member companies, affiliates, directors, employees and agents from any liability with respect to the receipt or use of this prize and agree to be bound by the Bluetooth SIG Giveaway Contest Official Rules. Bluetooth SIG makes no, and disclaims all, warranties, guarantees or representations, express or implied, concerning the condition, quality, merchantability, of this prize.
Entrant's Personal Information
Information collected from entrants will not be distributed to any other individual or organization.
Disputes
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than the administration of the Contest or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Arizona or the appropriate Arizona State Court ; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona.
